The National Do-Not-Call rules became effective on October
1, 2003. These new rules contain many counter-intuitive
details and therefore should be read carefully. All
brokerages and all independent contractors working within
brokerages should individually have records showing
compliance with these new rules. For more information
on Do-Not-Call or to puchase a list go to http://www.donotcall.gov/default.aspx.
The following links provide you with "model"
forms which you should read, personalize, and keep on
file. They are as follows:
(directions: click on each link for the specified
form, once promted, choose "Save," then select
the destination on your computer for where the file
will be saved. Note: These are Microsoft Word
documents, but most Wordperfect versions should be able
to open them as well.)
1. Legal
Update Article - provides basic background on the
issue, and sets forth the "safe harbor" practices
of: 1) establishing compliance procedures; 2) training
personnel on the procedures; 3) maintaining a do-no-call
list; 4) recording your compliance process.
2. Model
Do-Not-Call Compliance Procedures - to be used for
compliance training and kept on file.
3. Model
Do-Not-Call Compliance Training Meeting Minutes
- to be completed after your training meeting and kept
on file.
4. Model
Do-Not-Call Compliance Record - to be completed,
updated every month, and kept on file.
5. Model
Client Consent Form - to be sent to existing client
database for future solicitation calls beyond the 18-month
rule.
6. Model
Open House Client Consent Form - to be used as part
of your sign-in sheet at open houses for solicitation
calls beyond the 3-month rule.
