· H.B. 64--PRIVATE PROPERTY PROTECTION ACT AMENDMENTS; This bill creates an ombudsman in the Department of Natural Resources to advise both private property owners, and state and local governments on "takings" issues. (Support)
· H.B. 96--WRONGFUL LIEN AMENDMENTS; This bill prohibits the wrongful claiming of an interest in real property, provides a procedure for civil recourse, and provides civil and criminal penalties. (Support)
· H.B. 98--LOCAL TAXING AUTHORITY; This bill, among other things, requires cities to articulate a basis for imposing a business license fee based on "disproportionate costs." (Support)
· H.B. 114--TEMPORARY ZONING REGULATION AMENDMENTS; This bill prohibits cities and counties from using temporary zoning regulations to impose impact fees, but authorizes temporary zoning regulations prohibiting construction, subdivision approval, and other development activities within an area that is the subject of an Environmental Impact Statement or Major Investment Study for a proposed highway or transportation corridor (for up to three six-month periods, renewable if requested by the Utah Transportation Commission). · H.B. 171--HOUSING COORDINATION AND PLANNING; This bill transfers authority for housing coordination and planning from the state planning coordinator to the Department of Community and Economic Development and codifies other currently existing policies, funding, and practices. (Support)
· S.B. 26--SALES TAX OPTION FOR COUNTIES; This bill authorizes a county to impose a 1/4% sales tax in exchange for a reduction in property tax. (Support)
· S.B. 69--REAL ESTATE AGENT BACKGROUND CHECK; This bill requires a new sales agent to disclose his or her criminal history and consent to a fingerprint background check. This bill also authorizes the Division of Real Estate to issue a conditional license while the background check is pending. (Support)
· S.B. 70--EMINENT DOMAIN VALUATION; This bill requires agencies that displace landowners through condemnation to provide reimbursement in an amount the agency and the landowner consider reasonable for expenses, including taxes, relocation costs, and an independent appraisal. This bill also provides an arbitration procedure if the agency and the landowner cannot agree upon comparable replacement property. (Oppose)
· S.B. 71--LANDLORD-TENANT AMENDMENTS; This bill eliminates the right of a tenant to request an extraneous hearing on an order of restitution, and simplifies and streamlines the eviction procedure. (Support)
· S.B. 91--AIR QUALITY, LAND USE, AND TRANSPORTATION PLANNING PROVISIONS; This bill would have required city regulations and zoning to comply with an interlocal plan, and required permits obtained by landowners from cities (such as a building permit) to be checked for compliance with the interlocal plan and receive public notice and comment. (Oppose)
· S.B. 96--CITY AUTHORITY OVER CERTAIN RENTAL UNITS--This bill authorizes cities to require regulatory and business licenses for apartments containing three or more units. (Oppose)
· S.B. 124--TASK FORCE ON REGULATORY BARRIERS TO AFFORDABLE HOUSING--This bill creates a task force of legislators, and nominees from local government and the housing industry, to examine state laws and local regulations that increase housing costs and propose corrective legislation. (Support)
