UTAH CONSTRUCTION CONTRACTS PROMPT PAYMENT ACT; THIS ACT MODIFIES THE COMMERCE AND TRADE PROVISIONS BY ENACTING THE UTAH CONSTRUCTION CONTRACTS PROMPT PAYMENT ACT. THE ACT DEFINES CERTAIN TERMS. THE ACT DOES NOT APPLY TO A CONSTRUCTION CONTRACT FOR A RESIDENCE. THE ACT DEFINES CERTAIN TERMS. THE ACT DOES NOT APPLY TO A CONSTRUCTION CONTRACT FOR A RESIDENCE. THE ACT PROVIDES THAT, WITH EXCEPTIONS, THE PROVISIONS OF THIS CHAPTER ARE DEFAULT TERMS WITH RESPECT TO THE MATTERS COVERED IN THE CHAPTER AND ARE SUPERSEDED BY INCONSISTENT PROVISIONS IN A WRITTEN CONSTRUCTION CONTRACT. THE ACT REQUIRES PROGRESS PAYMENTS ON CERTAIN CONSTRUCTION CONTRACTS. THE ACT REQUIRES THE OWNER TO PROMPTLY DISPUTE A BILLING OR ESTIMATE WITH WHICH THE OWNER DOES NOT AGREE AND LIMITS THE AMOUNT THAT AN OWNER CAN WITHHOLD FROM A PROGRESS PAYMENT. THE ACT REQUIRES DISCLOSURE BY THE MOBILE HOME PARK OF CERTAIN RIGHTS AND PROTECTIONS OF RESIDENTS. THE ACT REQUIRES A COPY OF THE CHAPTER TO BE POSTED IN A CONSPICUOUS PLACE IN THE MOBILE HOME PARK. THE ACT REQUIRES MOBILE HOME PARK MANAGEMENT TO MEET WITH PARK RESIDENTS TO DISCUSS ANY PROPOSAL TO REDUCE OR RESTRICT PARK AMENITIES AND TO DISCUSS DISPUTED OCCURRENCES OF NONCOMPLIANCE WITH RULES.
